Terms of Service
Acceptance of Terms.
By accessing or using StayWell Health’s website, platform, or services, you agree to these Terms of Service (“Terms”). If you do not agree, do not use our services.
Our Role.
StayWell Health PC (“StayWell,” “we,” “us”) is a California professional corporation that operates a telehealth access platform. Medical services are provided by independent, licensed physicians and physician groups (“Providers”). StayWell does not practice medicine.
Eligibility.
You must be at least 18 years old to use this platform. By using the service, you represent that:
You are of legal age;
You are not barred under any applicable law;
If you are a non-U.S. resident, you will provide valid government-issued identification as required.
Use of Services.
You agree to:
Provide accurate, complete, and current information;
Use the platform only for personal, lawful purposes;
Not attempt to disrupt or misuse the platform.
Unauthorized use may result in suspension or termination.
No Emergency Services.
The platform is not for emergencies. If you think you have a medical emergency, call 911 immediately.
Intellectual Property.
All content on the platform (logos, text, graphics, software) is owned by StayWell or licensed third parties. You may not copy, distribute, or modify without permission.
Disclaimers.
StayWell provides access to telemedicine services but does not control or guarantee Provider decisions. Services are provided “as is,” without warranties of any kind.
Limitation of Liability.
To the fullest extent allowed by law, StayWell is not liable for indirect, incidental, or consequential damages. Liability is limited to $100 or the amount you paid for services in the prior 12 months, whichever is greater.
Indemnification.
You agree to indemnify and hold harmless StayWell from claims arising from your misuse of the platform or breach of these Terms.
Governing Law.
These Terms are governed by the laws of California and applicable federal law.
Dispute Resolution.
Any disputes will be resolved by binding arbitration, consistent with the separate Liability Waiver & Arbitration Agreement you must accept.
Changes.
We may update these Terms at any time. Updates will be posted with a new effective date.
